Unless he has video evidence of him ordering the "hamburger" and then getting a "cheeseburger," he will be hard pressed to get anything. My question as a juror would be "If you are allergic to cheese, why did you not look to see that the sandwich was free of cheese prior to eating it?" Also, specific to McDonald's, the cheeseburger sandwich wrap specifically says cheeseburger and the slice of cheese that is placed on the sandwich is bigger than the burger patty and bun, so there is no way that you would not notice that there is cheese on the sandwich. While we all have gotten our order wrong at a fast food (or any) restaurant at some point in our lives, I would believe that if something that may be an allergen to my body could possibly be in my food I would check before just consuming it. This lawsuit is just ludicrous.

In fact, fast food restaurants tend to get orders WRONG very often. One has to remember that the fast food restaurants give the "front line people" 2 MINUTES to take the order & COMPLETE it!!! It's no wonder there are so many mistakes!!!!!
But suing them for it??? Now, if I had to go to a hospital over it: I would file a complaint with the restuarant for any medical bills plus lost wages. And would not feel one bit bad about it. But 10 million?? That's quite ridiculous!!!!

yeah yur right! he's a ******* idiot! people in the fast food restraints aren't competent people! if they were they wouldn't work there! and this guy is obviously stupid! if you can't make sure a kid working at a McDonald's got yur order right then you shouldn't eat there! and really the lawsuits are getting old! if he was really worried about the people who have food allergies, which is over half of our population, then he wouldn't be involved in a 10million dollar law suit! he would be trying to fix the actual problem! he's in it for the money all the way, but he's also trying to take credit for a problem that most people are born with! he's a ******* wanna be hero! and he should be stoned and exiled for it! I really hate it when somebody trys to take credit for other peoples problems, or act like they give a damn! he's not standing up for all people with allergies! he's a greedy ******* dick!

I don't believe he should get $10 million. No one deserves that much. I can't find the answer to a few questions though. Was this one bite that did this to him or did he eat the entire hamburger? If I was that allergic, I believe I would avoid fast food places, mistakes can be made.

He could have. He probably did, thinking it wouldn't be a big deal. But as he was sitting in the ER, a lawyer found him and convinced him he could make an easy buck by earning a Stella award.

I think the restaurant should cover his medical bills and lost labor but nothing else.

EXACTLY! While I was reading this, I thought, "Well, why didn't that numbnuts LOOK at his burger before he ate it! Yellow is a pretty distinguishable color, especially on something that's burned. This is like that one case where that judge sued a dry-cleaner guy for $54 mil. over lost pants! Lawsuits these days are getting ridiculous.

I think that is stupid because one everyone knows that you should check your bag before leaving and two didn't he taste the cheese when he bit into the sandwich. I don't think this guy has a prayer.

haven't heard of it. suing mcdonalds because of the cheese? it's very obvious that he just want to get money. i have cousins who has allergies to some kind of food and they are very careful in choosing what kind of food to eat. it is because they know the effect of ingesting those foods.
he does not stand up for people who have allergies but he stand up for people who makes other people stupid and wants instant money.
bad bad example.
