I have been married to a person for 5 years.

Two years ago, I believe my spouse went
to Mexico and married an American citizen
there without divorcing me.

Can I sue both my spouse and the other person
for bigamy and claim for both legal and emotional
damage? (State of Texas)

You'd be suing the other person for alienation of affection. Your spouse would go to jail for bigamy so it wouldn't do much good to sue him/her.

If they are in Mexico, you'd be hard pressed to get anywhere with this - they'd just not come to Texas. The gov't isn't likely to spend the money to extradite a bigamist.

Bigamy is a solid ground for divorce though....

TRY CONTACTING AN ATTORNEY....or the mexican consulate..... i married a mexican national in texas, my marriage is reconized in america and mexico, just not through the catholic church...but bigamy is illegal..... i wouldn't sue for emotional damage...the courts are just overwhelmed with cases....why don't you contact this other lady and ask her.........who knows......she might not even know he was married at the time....

The ONLY person you could sue for bigamy would be your husband. HE is the one who married twice, not the other woman. As far as your emotional "damage"...you CHOSE to marry him.

on a side note...Too many people sue these days...let it go.

Your best bet is to get a lawyer. What proof do you have that he did this?
