Unfortunately, federal law mandated that states adopt statutes equating the signing of a birth certificate with a judicial decree finding that you are the dad. Due to this law, you have to go to court to get the birth certificate changed.

While, in your case, this law is unfair, it was designed to simplify the process of establishing child support in cases in which paternity was not disputed.

A lawyer is not going to get rich off of this case. If you have already done the paternity test, an action for non-paternity should be very inexpensive.

Let's look at a few numbers, shall we?

If the child is two years old, and child support is 300 dollars a month until she's 18 (and it can be longer) that's 16 more years at 3600 per year, for a total of about..... $57,600.

If a lawyer gets you out of paying that for a child that isn't yours to begin with and costs $5,000, that's a good bit less than $57,600.

Now, if a person could get rich by charging ME $5,000 to save me $57,600, I'd say they earned it.

But about your last question... why shouldn't a lawyer charge you to clean up your mistake? The alternative is that your girlfriend cons you out of $57,600. Add $2,000 to every $10 per month you wind up paying, it doesn't take a genius to see that lawyers are cheap for what you get.

As you signed the birth certificate and have been the defacto father for the past two years, your only hope in not paying child support is hiring an attorney, otherwise, you will be paying child support for the next 16 years.
