I got a rebate check for something I purchased. Now, I just got a letter saying they sent the check for the wrong amount, and I need to send them a check back for the difference. It's kind of a significant amount. Is this legal? (I'm in Missouri, if that matters.)

In response to some of the answers... it seems to be a legit letter, and I think they may have really made the mistake of giving me too much money. But I already cashed the check, and I feel a bit wary about just sending them money back. There is a phone number on the letter, which I plan to call tomorrow... but what do I say? "Hi, you screwed up, and you want me to write you a check for it?"

This is NOT a legitimate rebate. The check IS phony. WHEN the check bounces, the bank can and will hold YOU responsible for the FULL amount. You will be out whatever amount you sent back plus a returned deposit fee. If the rebate was legitimate, the letter is not.

Even if whoever issued the rebate was incompetent enough to send an incorrect check (i doubt it), from a pure PR viewpoint, requesting a refund would be more expensive than 'failing to discover' the error.

Personally, I would contact someone at the phone number listed and let them know why you are calling . Be sure to listen to name of the company when you call. Because they are only asking for the overage amount to be sent instead of the full amount this could very well be legit. This type of thing has happened to me before (insurance) and I've had to call insureds to tell them the money they received was for too much and asked that they return the just the amount that was overpaid. 9 times out of 10 the insured will send back the overpayment amount without a problem. If it isn't returned then that amount is usually written off at the end of the year.

This is a scam. DO NOT mail them back anything. DO NOT cash the check either. Yes it may look legit and innocent but this is a classic scam. I don't know the details on the letter you got, but if it is legit there should be a number to call or address listed. Do all you can to verify it before taking action such as depositing it. Honestly I would take everything you have to the police and let them look at it, also a trip to your bank to speak with customer service would be in order. DO NOT cash that check or send money back!!!!!!!!!!!!!!!!

sounds like a scam to me. they screwed up, so i say keep the cash. the company that sent you the check to needs to keep on their toes and keep and eye on their accounting dept.

Well, yeah, if they paid you too much money by accident, it's still their money. You have to give it back if it wasn't owed to you. They can -- and probably will -- sue you for it as well if you don't pay it back.
