Executive Privilege covers communication with advisors.
That is, if he was a paid advisor AT THE TIME HE SAID SOMETHING, THAT communication is covered by EP.
If he calls him up on the phone after he is no longer a paid advisor, then at least theoretically, it isn't protected speech.
That being said, NOWHERE IN THE CONSTITUTION DOES IT TALK ABOUT EXECUTIVE PRIVILEGE.
It is widely believed that Presidents need to be able to get "unfettered advice", but, similar to the concept that communication with your lawyer isn't protected if the communication itself is part of the commission of a crime, neither is Executive Privilege.
That is, if there is probable cause to believe that Rove & Bush were committing a crime, the protection ceases to be an issue.
Just as a nasty side snipe, I'll bet that Bush will claim that ANY communication made with the President is protected by Executive Privilege. That is, if he had an embarassing conversation with a model while drunk at his inauguration, he'll claim that is protected speech.

Whats it matter. He has already proven that he and his admin are above the law. I love how brianne proves she is one of the blind followers. It is every good American's right to question it's government, but the minute you do, whether liberal or conservative, there is always somebody like brianne claiming you are anti-American. Get a clue brianne.

By the unanimous 8-0 Supreme Court decisions, United States vs Nixon, he couldn't do it legally anyway.
in this decision, the supreme court decided that executive privilege is only valid when it can be shown that oversight into the actions of the executive office impedes its national security and diplomatic obligations. This is not the case in the US attorney dismissals.
I know, I know, history once again trumps the beliefs of Bush supporters. Bring on the thumbs down!
