It would depend on the access point.
In *MOST* cases, no.
If for some reason a military site, for instance, forgot to set the WEP key or password, then yes, it would be illegal.
However, there is no precedent for wireless bandwidth theft yet.

Only if you hack into a secure network. Coffee shops and hotels have free wireless, no password needed. Although some hotels give you the password for their secure net...

It depends. In situations like starbucks or McDonalds it's ok. The general rule is "If they know you're using the connection and allow you to use it, it's ok" If you're driving around your neighborhood and find an unprotected connection, then you shouldn't use it. Different places have different laws. In some places it's seen as an attempt to hack.

Yes and No...
If the access point is set-up for "free access," or it is your OWN router, it is perfectly legal.
If the person setting it up is either too lazy or stupid to protect his/her router, then it is very much illegal.

technically it is illegal, in the same sense that it'd be like stealing someone elses cable, it doesn't belong to you and you're not supposed to use it. However in 99% of cases they will be unable to prosecute you.
