voldemort had seven horcruxes. and on pg 568 dumbledore says harry's the seventh horcrux. but if you count there are 8 horcruxes.

even if we agree that there is an 8th horcrux, hermione says that voldy's soul cannot be split beyond 7.
HELP!!!!!!!

There are 7 horcruxes:

the diary
the ring
the locket
the cup

The piece of soul inside Voldemort is just a normal part of his soul, it is not a horcrux. A horcrux can only be a part of a soul that is outside the owners body encased inside an object.

Voldemort intended to create 6 horcruxes and have one piece of his soul inside his body, totalling 7 pieces. Voldemort didn't know that part of his soul was accidentally placed in Harry when he used Avada Kedavra on him, so there were actually 7 horcruxes and one piece in his body, totalling 8 pieces. This made his soul very unstable, because it had been split too many times.

Harry is not an intentional horcrux. Voldemort makes 6 Horcruxes (he himself does not count) prior to attempting to kill Harry. Since his soul is so weak and mutilated a piece of it is transferred to Harry when Voldemort uses Avada Kedavra on him. This transfer goes unoticed by both Harry and Voldemort. Once his soul is transferred to Harry (making it split into 8 pieces) Voldemort's power disappears and he is hardly even alive which sort of proves that Hermione was right. Voldermort's soul can not have been split into more than 7.

Assuming you're talking about the trio's conversation on the sunject in chapter six, on page 103 Hermione says she can't believe Voldemort made six horcruxes after reading the book. He didn't make eight horcruxes, the horcrux maker can not be their own horcrux. A horcrux is something you put a piece of your soul into. As you're soul is already in your body, you don't take out a piece of it and then put it back in.

Voldemort only made six INTENTIONAL horcruxes. As far as he was aware, he'd split his soul into seven pieces. But because he'd already split his soul into six pieces before he tried killing Harry, his very unstable soul split of it's own accord. That left one piece he didn't know he'd lost to seek out the only living being there and latch on to it. Harry became an UNINTENTIONAL horcrux, which meant that Voldemort then split his soul into eight pieces.

It's clearly not a flaw. Despite her reputation as a know-it-all, Hermione does not know everything. Later in the book she insists Xenophilius Lovegood made up the story of the Deathly Hallows to keep the trio at his house long enough for the Death Eater's to arrive. It's Ron who says that Lovegood wasn't making up anything, just saying what he believed because it's easier to go with what you know than make something up when under pressure. Hermione insisted that the Deathly Hallows were a myth, despite already having evidence to suggest they might actually be real (the symbol in the book that Dumbledore clearly wanted her to find, same as on the grave and Lovegood's pendant, not to mention Harry's invisibility cloak). Also, earlier in the series she didn't know what the Chamber of Secrets was, something that someone like her would have already read about had it actually been in a book.

Voldemort splitted his soul into 7 parts, he made 6 Horcruxes and the 7th part of his soul lies within his body. This was what he did intentionally.
Now comes what he did unintentionally, while trying to kill Harry at their first encounter, he shifted a part of his soul into Harry thus making him the 7th Horcrux.

i believe that when the little bit of voldemorts soul was transferred to harry accidentally and was unknown even to voldemort. when the killing curse back fired on to voldemort while trying to kill harry as an infant his soul attached it self to the closest living thing at the potters house which was harry. dumbledor explained it i cant remember exactly where though sorry. ***SPOILER*** that little piece of voldemorts soul is what was destroyed when voldemort again tried to kill harry with the killing curse in the forbidden forest in book 7

now that i think about it...
i think that he was trying to make a point that voldemort no longer has a soul. it's just become too mutilated and torn to be a soul any longer.
