In 1991 my husband was charged with murder he was at aparty with his friends and it resulted with a death of an individual. My husband went to trial and was charged by a jury for a murder that he never commited, yes he was there at the scene but never shot anyone. He was given 10 years probation and in september 2003 he broke his probation for being short on fees and for using marijuana went to court and was given 10years in prison. My husband always new who the shooter was . well the actual killer was in prison called the District attorneys and confessed to another murder that happen in 1991 my husband was taken to harris county to court to testify on this guy. but the actual killer confessed and got life in prison.the District Attorneys did not allow them to be together or speak to eachother. God works in mysterious ways. they were taken back to prison on the same bus.He told my husband that he was sorry and wants to help him. he wrote me aletter where he speaks the actual truth.

These people are all wrong (except Dawn), which is a good example of why Yahoo Answers is not a very good place for legal questions. The answer to your question is maybe the second scenario, but probably neither. It does depend on what jurisdiction you're in, but most jurisdictions require the judge to award attorney's fees based on the reasonable value of the services provided, and the loser has to pay those fees. When your lawyer works on contingency, that complicates matters because the judge will typically not allow the full 1/3rd to be paid under the applicable standard. So, say for example you recover 30K, and the judge decides attorney's fees should be 5k. The loser then pays 35k. Your lawyer is entitled to 1/3 of the principal damages - 10k. He does not get a bigger percentage because attorney's fees are awarded. You then have to pay him the other 5k out of your damages, and you go home with 25k. Another example: Damages are 30k, judge decides attorney's fees should be 7k. Loser pays 37k, you give that 7k to the lawyer, and another 3k from your damages to make an even 10k, and you go home with 27k. If you are getting attorneys fees because of a fee-shifting provision in a contract, then your opponent just might have to pay the full contingency. That is a matter of contract interpretation for the fact-finder.

As you indicate that your husband is in prison now, he should request a public defender. However, being on probation 10 years and "short on fees and using marjuana" while on probation it is likely not to make any difference that his "friend" now has confessed; your hubby was given a chance at a clean life and he blew it.

If you are truly dedicated to this loser, get a second job to pay the $5,000 for your own attorney.

I'm not sure but I believe a divorce lawyer would be cheaper.
Unfortunately if you stay with this convict it will follow you for the rest of your life in one way or another. Kick the loser to the curb. Find yourself a decent man and a decent life.

Unfortunately he was at the wrong place at the wrong time which makes him an accomplice.
