We have air bubbles coming from one of the toilets. They will not flush. When we run the washing machine, it floods the car port and backs up into the tub. We live in the city limits. The city has come out to check their lines and they said it is our problem. We had a plumber come look at it and he said that they may have to dig up the pipes in our yard. A friend of mine who lives in the area said they had the same thing happen. It turned out they had a septic tank instead of city sewer. My question is..we were told by the realator and the home owners that the home is on city sewer. If we find out that we indeed have a septic tank instead ( the whole while everyone in that house is paying taxes for city sewer) what legal action do we have? Will we be responsible for it? Has anyone ever experianced this before?

if the realtor listings and the purchase agreement says it is on sewers and its not the old home owner should be liable.is there large trees in your front lawn?if so the roots may have got into the sewer pipes

I would suggest you hire an attorney to look into it for you, you have several problems here, with the previous owners, the Realty company, the City. All may get involved but, if it's what you say, someone has to get your money back for you and your going to have to move. I would definitely sue.

I'm sure you paid for a "title search" that makes the loan guarantee or the lender responsible for the title and the loan on the property. They were suppose to do an title search and find out about all these things, you paid for it I'm sure, every state has this law to protect you against just this sort of thing. Now, they're responsible for the loan, they have to come up with answers.

chances are you have a clay sewer lateral, of which the city is generally responsible once it branches of their mains in the street, generally that's the homeowners responsiblity
the problem with old clay sewer laterals is they crack over time and tree roots will grow inside of them and thus clog them up, you can some times snake out the laterals and get you line flowing for a while, but if the problem persists you're going to evetually have to replace the lateral

It doesn't sound like you have a septic tank--the city or your plumber SURELY would have noticed.

You may have a lawsuit for "non-disclosure" of all these plumbing issues, though. Sellers are obligated to tell buyers about these things.

contact the agent if u used one or the seller.....check ur docs to see if it list city sewer or septic tank.....the city should be able to tell u if u r on city sewer.....then contact a lawyer if no one can help u.....sounds to me that ur on a septic tank.

i old contract the seller you brought the house from and they should tell you also the realitor should be able to tell you.
