Eviction problem?
my question is about my neighbor. he is living in a house that was abandoned by his nephew. he is allowed to live there by his nephew. he has permission. he decided to rent some rooms out to some friends and some other guy. but now he wants to evict one of them but the guy doesnt want to leave. the guy says that the house isnt his and he doesnt have to pay. what can he do to kick him out? thanks . i live in CA. contra costa county

take a look at the official website for California, under housing courts. There is an eviction procedure that needs to be followed, and that's where it starts.

It depends on how the guy was paying his rent and if he has fulfilled his part of the agreement. The owner could evict the guy since he owns the property. Laws vary from one area of the country to another. If it is a month to month rental and the renter is current on his payments, he will usually need to be given a 30 day notice to leave. If he fails to leave at that point an eviction notice may need to be served. He could be evicted by police in a matter of days once the eviction notice is served. My advice would be to talk to a local attorney. They will be most familiar with local ordinances and laws.
