yes
it's a misnomer to think that a signature is needed to get a divorce from both parties
a judge not he individual makes that final judgement ( after all one is suing the other in a divorce for dissolution of marriage )
a judge has to follow the rules
he cannot keep 2 people legally married by law if one wants out
most states are no fault states in that only 2 reasons can be given for divorce, and cheating is not one of them
just irreconcilable differences and fraud are the 2.
you at the minmum had to been served papers to show up in court, you do not have to sign, as the server is the one providing proof of service
if you fail to show the judgement is rendered
you can only contest i certain minimums are met ( depending on your state ), you can check the famly court in your area for records to see if you have been divorced allready by you seperated spouse

Yes, there are ways for a person to get a divorce without the other person's signature. The only way a person can do this is to prove that they ahve made a reasonable attempt to locate you such as even posting it in a paper that they feel you should read. To find out if you are divorced or not contact the courthouse in which you filed your marriage license first. They will be able to give you the information you need.

It depends on the state. Some states have 'common' divorce laws just like they have 'common' marriage laws. A common marriage is when two people live together and fulfill all the duties of spouses as if they were married but have never a ceremony in front of a judge or in a church. If they live together for more than eitehr 6 or 7 years, they are considered married by common law and all rights to settlements and property are treated the same as a marriage in most cases, depending on the states actually laws for it. The same is true for divorces and even for spouses who have disappeared and are presumed dead without fiinding a body. In a certain time period they can be declared legally dead so that the spouse can move on with their life. Some states just allow the spouse to divorce the person if the person doesn't show. That happened to my brother who was overseas in the military and didn't know there was a court date. She got the divorce and had him hit with child support. Unfortunately, the child wasn't his. He had been threated by two of her lovers that he found in bed with her one night when he came home early and he fled for his life. He transferred out for safety reasons and while he was overseas she took him big time. The court made the final decision and so he ended up paying child support. He was not given legal rights to see his supposed kid (and for good reasons) so he never knew that the boy she had was half black and belonged to one of the guys she was with that night. Her sister finally wrote him 15 years later about it and told him that the boy was actually not even living with her anymore. My brother was still sending the support since he had no clue it wasn't going to the child. He got a lawyer and the child support stopped immediately. He never got any of it back but he didn't have to pay any more. The boy called my brother one time wanting to see him thinking that he was his real dad and my brother had to tell him the truth. What a soap opera. Poor kid. Anyway, it's best for you to find out the laws and learn what you could be up against. You may need to get a lawyer.

Sweet Pea you have to be served the divorce papers by the Constable, and you have to sign them. It is a legal document. He cannot divorce you without the Justice of The Peace serving you the papers and you signature is on it. Good luck!

Yes. I know someone that her husband did that. She didn't know she was divorced until one day she received the divorce certificate by mail. And she had been separated for much less of a time than you. How he did it I don't know.

If you haven't been served papers then it is doubtful you are divorced.
