Okay so here is the 411, I am trying to help my mother out a little bit here. My mother lives in the state of Indiana and is currently in the middle of a divorce. My 14yo sister was living with my mom and step dad was able to see her anytime or pick her up anytime. Well after a year my sister wanted to live with her dad, closer to school and friends. Mom had no problem as long as she could see her anytime as well. Not the case now, she moved in with him and NEVER sees her mom now. He's playing the game really dirty. He is now dating a woman and just packed up the house and is moving and after 3 weeks of NO contact we are just now finding out they are moving. My mothers name is still on the house and still has items in the house. We believe he is going to sell the house and we were told they are having a huge garage sale and just letting people come in and select what they want and pay for it. This cant be legal! We have a lawyer but still wanted other oppinions. Help!

its against the law for him to sell communal property or property that can be claim by both parties, but ur lawyer should know this.. u really need to speak to your laywer, u can actually have him arrested for doing this

Make sure it's a good lawyer you have. If your Mom's name is still on the house then it can't be sold without her or her signature.
As far as the kid... well at 14 I believe here in Illinois a child can decide who they want to live with.

Tell Mom to deal with one thing at a time.
1) finalizing the divorce
2) getting her share of the house and it's belongings
3) rights to see the 14 yr old* only because 14 yr ols are miserable and they will make your life hell...

Do you have any photos of the belongings in the house ? Use these to prove what he sold. You can then go after him for replacement costs. He cannot sell the house if your moms name is on the deed.

Sounds like she may need a different attny. How long has her divorce been dragging out? And WHY?
Something sounds very unusual here.

You can get an injunction to stop any sales until the divorce is final.
