im am upgrading from home basic to premium i have a product key for premium but it has been used befor will i need a new one for upgrade

Yes the one that comes with the upgrade... but if you look around in the torrents you might find one.

Is the instance where you used it before on another computer, one that is still running Premium? Then yes, you need to purchase a new key. If do not currently have it installed on any other computers, then you can use your current key.

Yes, you cannot use the same key twice on different computers.
