If Mom has legal custody of the child, then she can file for child support. Dad then needs to inform the court that the child isn't living with her. But in the end, he will have to pay child support to someone, because, of course, he is responsible for providing for his child.
In my opinion, here's what needs to happen--whoever the child is living with should be given custody/guardianship and then BOTH Mom and Dad should be ordered to pay them child support.

No. In order to file for child support the mother must have custody of the child.

Not unless you are supporting the child in some way -- for example if they are living in a boarding school and you are paying for the boarding school you could file.
Otherwise, you are not likely to get the support.

One Word, NO! However, there have been people who have gotten away with doing this, but you should have custody first or it should be the person who is taking care of the child who files for support

If you did support the child in the past, and there's back child support due, and you can prove the expenses, than maybe.

UH...Child Support is for the care of the kid. It's not "Mommy" support. Whovever you have taking care of your child at the moment, they can file for it.
