Because it's an old phrase dating back centuries -- it refers to actions and events that are beyond human control.

The other term for the concept is "force majeure".

Because it's a very old legal term that means something very specific. Changing it could screw things up big time. It's just a legal term, don't sweat it. It doesn't even mean God any more. It's just like lots of other words that have lost their original meaning.
