Why isn't it considered unconstitutional?

Do you really believe that criminals won't get their hands on guns anyway?
All they are doing is leaving good law-abiding citizens deffenseless.

That's a good question. I don't know. They might as well take away the freedom of speech too.

1- the constitution says that states can have a militia made up of citizens. it doesn't protect the rights of people to just own guns. we do have other laws for that but not in the constitution. people in militias can have their guns at home. I know Michigan has a militia, regular citizens with guns who legally could be called on in the same way the national guard is called on (I don't think it has happened in a very long time however)

2- the constitution also over turned prohibition but you can still find many 'dry' towns and even whole counties.

3- some argue that if a all guns were illegal it would stop criminals over time. some criminals actually have legally purchased guns because we use the honor system in some place - IE you sign a paper saying you don't have a record and are eligible to own a gun and they don't check to see if you are lying.
in this case every gun would be confiscated and the person would be charged. they'd also have a extra charge for importing since no guns would be sold to the public

4- other countries only allow hunting rifles. some less strict places will allow handguns as well. and other don't allow citizens to own guns period. rather or not this works out well if debatable. but we have one of the highest rates for gun-deaths in the industrialized world.

Because they haven't banned guns completely they can argue they haven't done anything unconstitutional. They ban semi-automatic rifles and handguns, which are what we need most under the Second Amendment. The truth is, any law that restricts a law-abiding citizens from buying any firearm is unconstitutional.

Oddly, firearms are a state issue. 43 states have a right to bear arms clause in their state constitutions, seven don't. However, even in those seven states state rules usually don't allow individual cities to 'ban' all firearms. States can enact certain laws to restrict certain aspects of firearm ownership and publish rules as to time place and manner of use. State constitutions can't totally ban the ownership of most firearms though they can ban certain firearms. At this point the Supreme Court has never actually ruled on the totality of the Second Amendment...probably because if it did it would overturn most firearm restrictions and realistically not many people want that...but then again, many do.

I believe that most bans have ways around them. If you have the propper permits you can still carry a gun in most places where they are "banned." I was talking to a private security gaurd (talk about the last guy you want strapped yikes) and he was telling me about all the stuff you have to do in Illinois to carry a gun whether you're working or not. It was a while ago though and I don't really remember what he said.

You just have to get the right paper work in order I think the point is to not walk around like the old west, but don't worry you can still have your gun. Happy?

The same way the federal government gets away with social security - read the Constitution, social security is unconstitutional. Oh, that's the answer... most Americans have no idea what the Constitution says. Most Americans also only care about their own little lives at this very moment in time... they don't care about other people, and they don't think ahead to future implications of current actions.

Japan, China, France, Germany, Italy ban guns and their crime rate is 150% higher than the USA.

US crime rates are sooooo low because each Americans has a gun.

the second amendment has been traditionally interpreted as a federal government's limit against the states and cities.

so cities can outlaw guns, but the feds can't hurt the cities.

They offer security in place of liberty. Along with a well publicized tragedy--that is usually enough to get people to go along with it. Or they just do it and no one thinks they have the right to complain.
