If he doesn't live with you, yes you can petition for child support. It won't be awarded until the baby is born, but you can still go and get the paperwork started.

My friend is an illegal immigrant and he pays child support. As long as you prove that he is the father, ( the court will maybe ask for a blood test) he will have to pay child support. It doesn't matter if he is illegal. But i don't think, still being married to him will help out much. Child support is mostly for for couples that are no longer with each other. And also if you are breaking up with him and you have been with him a long time you can ask the court to make him pay for you and your child. I don't know exactly how to file child support in Texas but where I am at you got to the nearest court house in your city and ask them that you want your husband to pay child support. Another thing if for any reasons the father of your daughter denies and says that he will not take responsibility for his daughter. The court will ask him to sign a letter giving up on his child. After that you cannot ask him for child support but he doesn't have the right to ask for your daughter since he denied her.

You can file for child support any time at all...however I suggest you FIRST file for a legal seperation, otherwise he can drain all of the bank accounts can put your home up for sale and keep all of the proceeds and leave you out in the cold with nothing but the bills to pay with a baby on the way. Once you get a legal seperation this "freezes" ALL Marital assets and then you can go to court and file for child support but you'd better hurry.

before the divorce is finalized you will have to go through child custody and support issues.
But don't worry... the child support goes back far enough to when he stopped being in the childs life.
I know this guy who was in his son's life for the first 2 years.. his girlfriend told him she was going to see her mom in Washington, and never came back. She filed child support on him.
He has backpay of over 4,000 dollars and he has nothing to prove that he was there with the child from birth until age 2.

You will get your child support.. I know this lady who didnt start getting her child support until her son was age 15.. the father bailed out and it took her 15 years to find him...but still gets backpay which will continue even after the child is beyond 18 until it is all paid up.

Yes my husband, after not paying child support for years to my daughter. Now pays child support to her, even though we are legally married. but the child support order, was in place before we got married. Its a long story but as far as I know he can pay child support while married.

I doubt it matters whether or not your married, seperated or divorced. I think you can go after him for child support if he's not living with you or supporting the child.

Absolutely you can take him to court to make him pay support you just need to prove he isn't contributing.
