Actually, that has been determined in a court of law. According to some jurisdictions, if you own the land you do not necessary own the mineral rights (to the center of the earth) or the air rights (to the sky). But it depends upon the local laws and how land ownership has been interpreted.

Rarely , most property sold today has already had the mineral (below ground) and air rights above a certain level sold .
But check with your county land office , they may have the specifics for your parcel .

Oil and Mineral rights are separate from the land. Its almost as if the land has two parts to it. Its rare to see the oil and mineral rights transfered as part of the land.
