the one employee is always mean and rude, to the point of causing an uncomfortable tension filled work place( other employees think its funny) and love to see it............upper bosses think it has nothing to do with them.............its is in a public retail area............

Not acceptable. Document carefully - when where, what was said, what was done, who was present, and don't forget to publicly tell them, "Please stop doing this, your actions make me feel uncomfortable and intimidated" - and after a period of time of good documentation, show your employers that it WILL affect them if they don't stop it, as you will sue them AND the employee for workplace harassment - and note you are documenting that you have informed them as well - and keep your original notes, give them obvious copies - that sends the message as well.

If upper management is aware of the situation and continues to do nothing about this than there is legal action that can be taken depending on the type of harassment. The company is responsible for maintaining a work environment free from harassment.
