Is this Legal? Her Checks come in her 2nd husband last name but every body says she can't do this legally. But she does. So she is honest with them. She remarried 20 years ago. But never lost her widows social security is this right?

.no it's not legal,they can get her for fraud, and forgery if she changed her last name when she remarried.it's people taking advantage of the system that screws it up for everybody else.in my area if you report someone doing something like that you get a reward. so how good of a friend is she? i know what i would do. but i work with a social security office.

If she was married to her first husband at the time of his death, then she is entitled to it. Suppose she never remarried, but just lived with the man who is her second husband? The checks would still come to her and there would be little difference. The same goes if the first husband had a term life insurance policy that paid out over 20 years- it doesn't matter what her last name is, the money goes to her social security #.

Her first husband was probably the only breadwinner while they were together. It was just the way things were back then. She has no social security income of her own that would amount to much.

By your story, she remarried at 64. It is legal for her to continue to collect social security benefits as the widow of her first husband.

I don't see why it wouldn't be legal if she was married to the guy. Her remarrying doesn't "disentitle" (is that a word?) her from her first husband's benefits. I could be wrong cuz I don't know all the rules of soc sec...but I don't see why she shouldn't still be entitled...(that could be why the second hubby married her, cuz he knew she came with a check!) If it was illegal, would you report her? Is she a "friend" of yours? (for you to know what checks she's getting).

She can collect his SSI if she is his widow.
If she was divorced from him and never remarried, she could also collect it.
But if she were divorced and remarried, then she loses her rights to it.
So, in answer to your question, yes she can collect his SSI as she is his widow and not a divorced remarried spouse.
