Q.: What is perjury?
A.: In general, perjury is deliberately making a false statement under oath. The word "perjury" is derived from two Latin words, per (through) and jurare (to swear). Its roots can be traced to religious doctrine which forbade invoking God to confirm a falsehood. Under modern law, however, perjury statutes equally apply to "affirmations" which do not invoke the Deity as well as to oaths that do.

Q.: Does every false statement under oath constitute perjury?
A.: No. Historically, the crime of perjury could be committed only in the course of a lawsuit or judicial proceeding. However, the states and federal government have extended the definition of perjury to include willful false swearing in many different kinds of affidavits, depositions and government filings, such as tax returns. Consequently, there are many perjury statutes under both state and federal law, each of which covers false statements in different situations. Nevertheless, many sworn false statements still do not amount to perjury. For instance, a false statement is perjurious only if it is intentionally false. Additionally, under both Ohio and federal law, a false statement must be "material" to constitute perjury.
