I am currently divorcing my husband who still is in the home, he finally after 5 months received his papers and he refuses to leave, calling the cops wont work, he is verbally abusive to my two daughters and is making home life MISERABLE> I filed in Feb and now that he has recieved the papers, his number 1 mission is to make my life a living hell. He doesnt work, doesnt pay the bills, he is a BiG TIME FREELOADER any helpful suggestions would be appreciated. We have no lease, it is a verbal agreement between me and my former boss. Im not looking for criticism, Im in need of good advice EXTREMELY MISERABLE AND IN NEED OF GOOD ADVICE.

kitty - if the home is owned by your boss, and there is no lease with names on it, then it is considered a month to month lease for each individual in the home. Your boss can give HIM notice to vacate the premesis, while you can stay. Depending on the state you live in, the notice can be as little as 3 days and as much as 30. He would need to check with a real estate attorney.

In the meantime, spend as little time in the home as possible.

If you had an agreement with your former boss, you should talk to him and have him evict him from the house. He is not paying any bills or anything else. The next time he is verbally abusive to you or your daughters, record it, call the cops, file a restraining order. You could even go to the police dept and say that he got physically abusive with you or was threatning you and your children but he will not leave the house and you want him out of your house and a restraining order to keep him away. If this doesnt work, the next time he is out of the house, run and get someone to change all of the locks in the house and put his things out front to where they will not get damaged or stolen so that you will not be responsible for them. Whatever it takes to get him out is what you need to do. Take drastic measures if you have to. Go start a fight with another woman and let her get a few good licks in so that you have marks and then go home and call the cops saying he hit you. They will eventually get tired of you calling and will make him leave. If you show them the divorce papers and tell them that he is supposed to leave, they have to take him. Get your lawyer involved in order to make him leave the house. Try everything you can think of and may be able to get away with. Other than that, all I can say is try to make him just as miserable as he is making you. Take the computer away and put it into a room with a lock on it. Things like this. Put a lock on the fridge so that he cannot get into it. The only thing is that he could become more violent with you over this, and neither you or your kids need that. I do believe your best bet would be to have your landlord evict him as soon as possible. There is nothing he can do about that.

find somewhere else to live where he cannot be on the lease..explain to your landlord not about the problems you have with your husband...but that you want it to be absolutely legally clear that you and ONLY you are on the lease and that YOU refuse to have ANY other adult on the lease..even if some stranger comes to your landlord and wants to talk him into allowing that person into your home..the landlord must legally say.. "Nope".

Also.. if he is abusive to your kids.. why havent you called the cops for that? They will take him into custody and you will not bail him out. If his friends are bailing him out..you tell them to stop please because he is abusing the children. You can also get court orders protecting you and your children from him if he is indeed abusing your children. He can be forced by court order to stay away from all of you no matter what.. including church.. school etc. he can be refused visitation rights etc.

Depending on what state you live in..sometimes certain court forms can be downloaded from your county internet link... also there are online a few websites in various states in which you can pose a legal question which a real attorney will answer for free. Remember to NOT give out any of your personal information no matter what. For that you get a REAL attorney with a real office where you live.


I have to wonder and i don't really want you to answer me specifically..sorta look into your own eyeballs in the mirror and ask this of yourself.. why are you still there? Come on. Are you so used to abuse that you consider it your way of life? is that what you want to teach your kids? Stop being stubborn and GET OUT OF THERE. Do not tell him what you are doing. Just do it. Act.

Maybe the boss being the owner of the property could throw him out?

Ask your lawyer or get a lawyer to put a restraining order on his ***!!!

Either your former boss gets him evicted or you leave.
