So i live @ these apartments in San Jose. And I've been trying to deal with the office staff and get things resolved and they just keep making things worse. We recently got a new neighbor and he has a surround sound and he blares his music so loud my picture fell off the wall. So I called security and they never showed up. The next day the same thing music blaring all day, the office was open so I called the office. They came up and told him he needed to turn it down. He asked them who called on him the guy who works in the office points to my apartment and says "they did". So not even a 1/2 hr later the neighbor knocks on the door and is like can I talk to your boyfriend? So the management told him we called. Isn't it supposed to be confidential? Then this past weekend he's blaring his music. One of his friends accidently opens my door and walks into my apartment and all i can smell is marijuana coming from his apartment so I call security. They don't want to deal with it they call

call the police. Police come smell the weed search his apartment and leave. He goes down and talks to the manager of the apartments, The manager TELLS him that we called security on him twice.
IS THIS ALLOWED? Who can i speak to since the manager isn't taking care of this? There has to be someone above him...
Now i have to worry about what my neighbor is going to do and live in fear.

Go to your property mgmt. company or landlord. I guarantee you they will take action b/c they don't want scum like that in the buildings. It will cause vacancies and if prospective tenants see them, it will turn them off. You better believe they will act fast.
You are in no confidentiality agreement w/ your on-site. You can be anonymous with the cops, but that's it. I live in SJ too and there are some pretty shady apts there. If I were you, I would just move. But it's not worth it sometimes .... plus, if your on-site manager is acting like this, I'm scared to ask what else they are / are not doing. Plus, you can probably find somewhere with lower rent starting in Sept. that's when the market quiets down a bit.
But call your prop. mgmt. company or landlord and tell them the situation. They may need to get a new on-site and then the new one might actually do something about it.

edit - most places have a lease break fee. Or just say you are leaving and they can keep your deposit. All they want is money .. if you offer a compromise .. they will most likely take it.

After reading this, I'm worried for you now. Its sad to hear you have to feel that kind of fear living in your own home. It sounds like the police didn't find anything in their apartment during the search. I'd contact the owner's office of the apartment property. The owner's office most likely own more than 1 apartment complex. They also have ultimate control over the manager at your premises and can override/take action/fire at their leisure.
I'd admit I feel that the manager's pointing of fingers so soon was a cowardly tactic, but I don't have sufficient information so this is just my first impression.

The apartment manager isn't legally bound to keep what you said or did confidential, but it was kind of a jerk move. However, the neighbor cannot retaliate against you, and if he does, call the police and report that he's harassing you after you told on him for a valid reason.

Call the police yourself and file a complaint. If the apartment manager will not fix the problem, move.

seem up your close by buildng inspector or call your close by well being branch ASAP!!! i understand this lady who made a fortune off stuff like this. there became mold in her house. Your complaints to the manager are not protected by any sort of confidentiality requirement. Your police reports are to some extent unless you are also the accuser in which case the defendant has the right to face you in court.

I'd talk to the cops first then get a lawyer, or better yet, move out of over-priced, over-crowded, and crime-ridden SJ.
