I live in New York and yes it is illegal to talk on a phone, you must have an earpiece, however, we see the State Troopers, Sheriff's and the village police, using their phones all the time, without the headpiece. People do it all the time here, its really sad. Just last month 5 young girls just graduated from high school lost their lives in a terrible car accident, the driver was said to have been text messaging on her phone when her vehicle swerved into the lane of an oncoming tractor trailer, she hit the vehicle and the vehicle burst in flames, all the girls were killed on impact. The laws should be stricter, but I dont know what they can do when the police don't abide by the law

I'm in NJ and there is a reason why this law was passed. People on cell phones, first of all, are too pre-occupied to even see a person crossing in front of them, and to also have to make a turn while they have a cell phone is harder. Imagine if you have to stop or else you and your car would fall into a giant hole. Do you think you could stop if you were talking on a cell phone?
I almost got hit while crossing a crosswalk because the woman driving was too busy talking, and didn't bother to look both way before clearing the stop sign.
Also, they don't pass these kinds of law until too many people have been killed.

I am in IL. So far it is legal to talk on a cell phone, but in Chicago, it can only be done using a "hands free" device. It is illegal for people driving buses anywhere in the state (at least school buses).
I usually keep mine turned off in the car, and if I am expecting a call I use a cord free headset. If I need to call, I use the headset and I have voice dialing. I think distracted drivers now cause as many accidents as drugs and alcohol.

Why should our gov't have to enact laws to keep people from doing things that put others lives in danger. Driving is a serious undertaking that requires all of the drivers attention. We need to realize that multi-tasking behind the wheel of a motor vehicle is not acceptable. Put down the phone, the make-up, the razor, and the cigarette and pay attention to the task at hand or people could be killed. There, now I feel better.

I live in Missouri and they are still trying to pass the law. I'm against it. It's discrimatory. What about the people who eat and drive? Put make-up on, swat their kids, fall asleep, change cd's, read?
I have my phone set to where I say the person's name and it dials. I think talking is fine if you stay alert to your surroundings. Text messaging though seems dangerous to me.
