my ex boyfriend has visitation but I told him I dont want his girlfriend to come with him (for good reason) so now he says he wont come because he wont go without the girlfriend but the girlfriend is telling me that she is going to bring me to court for contempt of court because of him not coming for visits she is saying I am not letting him...is there any way I can prove that I am allowing him to come but he is choosing not to??? like proof in case I go to court to show that I wasnt stopping him???

The new girlfriend has no rights in the matter whatsoever and she cannot legally file anything in the matter. Your ex might have grounds; it will depend on what has been stipulated in your visitation agreement.

It would be in your best interests to contact your attorney to see about getting the visitation agreement amended and their recommendations on withholding visitiation until then or not. An argument could be made that it will only confuse the child to be involved with your ex's girlfriend simply because she is not a permanent fixture in the man's life (she is not his wife) and it could be emotionally damaging for the child to be exposed to your ex's "flavor of the month" if he has had a sucession of them in the past.

Would not recommend recording anything because not only is it likely it cannot be used in Court as evidence, you could be in trouble for illegal wiretapping. E-mails, on the other had, are admissible in a Court of law as evidence. Stop talking to them on the phone and get what they are stating in writing via an e-mail or an IM (be sure to both save both and print them off) and be very careful what you say.

Another thing would be to start a journal of all contact with both of them.

The Court will decide what is in the best interest of the Child.

The girlfriend has as many rights in your custody battle as a gitmo detainee so I wouldn't worry about what she says. If he chooses not to come that's his problem. I'm sure your visitation order doesn't say anything about her getting to come.

use a voice recorder and talk to him .. and then prove it in court.. like ask him why he wont come.. (but dont tell him your recording the conversation).

Unless you can prove that his gf is a danger to your kid, you don't have a right as to how or who your bf can be when he visits your child.. I don't think this was the answer you were hoping for but that's the way it is..

coz u dont have to part with him. i n no way it is upto your discretion and you will defenitely rewarded fot this kind of act in future alsoSo stay in touch with him and his girlfriend
