Does anyone here have any information regarding the process of who do you go to, expenses, ect of having a will done to protect your childrens welfare in the even their parent dies? I want to make sure theres some way I can give legal custody to my sister and her husband, and have it legalized for their protection. Thank so much for your input.

You can get an lawyer that does wills for about $1000.00 you can make payments if needed, they charge a little interest to do so, my wife and I just had ours done, living will and trust is what you want and yes you can put in the documents for legal custody of children, good luck.

An attorney can write a will for you, and you can state in the will who you would like to be given custody of your children. But be aware that you cannot actually will your children (they are children, not property). Therefore, the court is not required to abide by your wishes in that regard, but they will try to abide by your wishes, if possible.

Where’s Dad? If you die, then Dad (assuming he’s still alive and his parental rights have not been terminated) is first in line for custody and if he wants custody (provided that he’s not unfit) he will get it over anyone else that you’ve stated in your will.

The Nolo series of legal books are pretty good. Get the bokk from a local public library and you can probably complete a valid will yourself, or just be more educated if you do end up using an attorney.

Stay away from the online wills, if you are intent on making sure they go where you want them to, then contact an attorney and have it written.

If their father is still alive, it may cause problems but your attorney can fill you in on that much more thoroughly than anyone on Yahoo Answers can...:)

go to a attorney i dunno where you are located but nikki stowell in st pete, florida is a person that you can trust( i was a student of hers)! i think they cost around 200 and they are the only way to go to get a will done!!!! you get what you pay for and if you want to ensure your kids go to who you want thats the way to go.... other wise people could fight your sister and say that she made a will over the internet for you and so on.... it could turn into another terri shiavo case...:) good luck

my b/f just done his and all he done was ask a lawyer.and she told him to write it up or type whatever u prefer and get it noterise by a noteripublic..it has to be noterise before it can count, or u can call a lawyer and just ask him/her and they could tell u how about going around and doing it...
