My younger brother & his ex-gf have a baby on the way. She says that the court will make him pay child support even if she doesn't file for it or want it because she is on Medicaid. Is this true?
(we live in texas)

Absolutely. I live in Wisconsin and also get state assistance (insurance, food stamps and daycare assistance). They are right on top of getting child support. And if you don't cooperate with the child support agency then the state will take away your benefits. Also, my daughter's dad is ordered to pay child support and has yet to give me a dime (supposed to start paying in May), they have also been on top of why he hasn't paid and if he doesn't pay by the end of this month it's a felony and he will go to jail. All of that happened without me having to call and report that he wasn't paying anything.

The reason she has medicaid is because of her financial status and because neither she nor your brother have the means to acquire insurance. As for child support all she has to say, that's if she is in good terms with daddy, is that he provides for her financially in cash. All she will need from him is a note that he does so and they WILL NOT pursue him. She does not have to file for child support unless she wants to. I also live in Texas and have been in this situation and this was the resoloution because dad and I are in good terms and he does provide for me financially.

Any kind of state assistance that she is on will automatically file child support against him. Even if they are living together.

Yes it is true when you are getting assistance they do file for the support. I am not the one that filed for support for my boys they did.

in nc, she can choose not to pursue child support, however he will be court ordered to provide health care coverage for the child or they will take away HER coverage. She cannot stop it.

Yes this is true. She will have to supply his ss#, etc. The purpose of this for the state to recoup the $.
