I have this girl calling me saying i "need to watch my back", and i changed my number yesterday. She somehow got my new number and had someone else call me and she blocked the call. Shes leaving me messages on myspace calling me a whore and everything else. Is this enough for a restraining order? I had my car broke into a few weeks ago and think it might have been her also. I have a young daughter, and as a parent i fear for our safety. She hangs out with the wrong crowds.

Woah! First things first, someone telling you that "you need to watch your back" is essentially a threat. Second off if you can prove that it is this same person or one of her "friends" that keeps calling you after you have taken appropriate preventitive measures-and having the reason that you changed your phone number to keep this person from calling you-that is harassment. The Myspace messages definitely aren't legal but I am not sure exactly what laws those would be breaking, a lot of that could have to do with what state you live in, but if those messages are crossing state lines, that technically is a federal crime. My advice to you is get a good lawyer and go make some freakin money.

Oh yeah and to answer your main question about the restraining order, that is a very sufficient amount of illegal instances that would keep her far far away from you, your daughter, and your property.

Although there are general rulles to harrasment. It in the end depends on what's individual definition of it. Sometimes it has to do with the levels of high and low tolerence.

For what I see it could also count as a threat. She is invading your life and everything else. If your worried about safety it shows me that something needs to be done about this.

What I'd do is go to the police & the courts right away. If you have time which you probably will. Start recording this like don't answer the phone; to use the answering machine to record the threat. Also make sure you print the threat off your myspace page. Evidence makes a case more significant and unique.

Oh yes, it's called "Terroristic Threatening"...which it doesn't sound like she's done it directly, but it's enough to make you feel endangered. You can almost certainly get a restraining order, harassing calls and messages definitely qualify as harassment. Go ahead and contact your local law enforcement, the worst they can say is "no". Hang in there!

Yes in most jurisdictions that is enough to obtain a restraining order.. go to the police and get a police report to file with the courts requesting a TRO(temorary restraining order). And if the person continues to contact or threaten you in anyway you can have them arrested. In my reference I have provided a link of the common process in getting one.

if you can prove all of this, then take it to the police. did you call the police when your car was broken into and get finger prints? so then get an attorney and give him/her all the documentation and the attorney will go to court and get you a restraining order. bottom line is you have to show proof.

You need to get in touch with the authorities!This one sounds like half a nut-job already.Besides,you have a ttle one to think about.Listen to me!Take this fool seriously!if she went through the troble of finding your new no.,what else might she do? Your safety is a risk.Take action!

yes that is enough....it is considered threats and you can get a restraining order for that...i had to get one for similiar reasons once

people who make threats have been known to carry them out.

You may be able to get her arrested for harassment or you could just shot her.
