since he can't ride on the road, get him a dirt bike - and don't forget to buy some good riding gear!

If you must, get the kid a moped.
No 13 Yr. old is mature enough to handle anything
that goes over 30 MPH, and most, not even that.

depends on the height of your 13 year old and what kind of riding will be done. More than likely a 80cc or a 125cc dirt is a good starter bike but once again your child height will play a role and to be honest as long as proper maintance is done it should last as long as need be.

Stick to dirt bikes 150cc and below. (and stay off the roads)
Chinese is not a bad way to go. They are cheap and "disposable". So what if it gets trashed. You'll probably wind up throwing it out anyway when the kid reaches 17.
