Ok. I was living in a sublet for a month and a week, no lease. But, I paid 2 full months rent. I called the landlord when I was leaving, so I gave him 30 days notice. He didn't say anything, he told me he was going to call me back. But he didn't, and I tried to call him again.

I just forgot about it. And then today he calls, says that he couldn't find anyone to rent for August, so he wants me to send him a check. First of all, he did not tell me he was looking for someone, or else I would have made sure I found a new person. And then he calls me out of the blue demanding money.

It was a short term agreement. I even asked him if he wanted me to sign a lease, and he said no.

What to do? I feel horrible about it, but, again, he didn't want me to sign a lease, and he did not call me for over a month telling me his intentions. So, I had no idea this was on my shoulders.

Please help!

Don't give in. He probably thinks you are weak and if he threatens you enough, that you will give in. You may also want to keep your phone records just in case you have to go to court. Then you can show when you called for 30 day notice and that he didn't call you until it was too late.

So this is a sublet - ie he has a lease with someone else but nothing signed with you. Not sure on this one becuase this beinng a sublet he has something signed by the original renter, but not by you. I guess (since you apparently signed nothing) he has no recourse againist you. He might have some recourse againist the original renter but I even doubt that (essentially he took you on to replace the original renter thereby making the original lease no longer valid - but since he never signed anything with you, you are not bound by that lease).

Best guess. I think you essentially have a month-to-month rental with this guy with no lease in place. That being the case I don't think he has any recourse againist you or anyone else. If he took you to court you'd say you gave proper notice and it was a month to month rental (with no lease). Only thing he could claim was that you didn't give proper notice (since you didn't have him sign anything - next time send written notice with return recipt requested) but he isn't even claiming that and since there is no written lease its essentially your word againist his.

So, probably nothing he can do about this if you just move out (yeah he can sue you, but I think he'll lose). May want to run this one by a lawyer though. Also many counties has a landlord - tenant relations phone number (may be called something else). If your county has one try calling that and asking them if he can do antyhing.

You're not legally responsible to do anything, but if you just want to do something nice for the guy maybe you could send him a couple of prospective tenants and a bit of advise to have a lease signed in case not everyone is as nice as you. Some people will try to stick ya.

When did you give him notice? Was it written or just over the phone?

You had not lease, you only had to give him 30 days notice. However, it should have been in writing.

I would not pay him, but anytime you do somthing like that, always cover your bases or it could come back to haunt you.
