In law (criminal) and cases to do with strict liability, what is the definition of Necessary Evil, and what is it?

For that, you need to look to case law. I won't do your homework for you. However, the common sense definition does indeed suffice. In most states Rape is a strict liability crime. No culpable mental state is necessary....after all, how can you recklessly or negligently rape someone?
