You shouldn't worry if you have a copy of the signed agreement. Landlords always take deposits in case you mess up the place or even decided that you don't want to rent this place anymore. This is the cost for them to reserve the place for you and for paperwork. Sometimes, landlords forget to take down an ad that they posted. Not everyone has time to do everything on a daily basis. Plus, people pay companies to post an ad for them on a certain amount of time, it must of not been over yet. If you're really worried, why don't you call the landlord and ask?

The landlord is fully within his or her rights to take a backup deposit. People back out of rental committments all the time.

This actually can protect your deposit since if you back out the landlord will have a ready replacement and you'll be much MORE likely to get your deposit back.

IF YOU HAVE A RECIEPT, I WOULD DEMAND MY MONEY BACK OR I WOULD SEEK LEGAL ADVICE TO BE ABLE TO RENT IT,
