How do I find out if the atty or opposing atty has been unethical, this has been ongoing with no sttlement or resolution, I want my atty fees back also. What do I do?

I have custody, How do I find out if my atty or the opposing atty has been unethical? what do I do?
I also want my atty fees back.

If we go to court could I get my attys fees back?
This case is just maliousness of the "dad".
I have custody.

If you are unhappy with your present attorney then by all means consult another. You can discuss this with your current attorney as to how you feel. It might help to get the case resolved.

As far as your fees, if the attorney can show that he or she did the work that you were charged for, I doubt you will get your fees back.

If you feel any attorney has engaged in unethical conduct, every state has an attorney disciplinary body where you can file a complaint. They will investigate and if they agree, then they will proceed against the attorney.

Contempt charges, by definition, imply that a Court Order has been violated. In absence of this alleged violation, you would not have needed an attorney and you would not have incurred additional attorney's fees. If you are represented by an attorney, he has a right to expect payment for his services (his hourly rate is usually spelled out up front in a contract with the client). If you suspect he has committed some act of negligence or misrepresentation in this matter, then you may file a grievance with the local or state Bar Association and they will investigate and determine the validity of your complaint.

The duration of a Court case isn't determined by the attorneys....it is usually determined by the opposing parties themselves and how willing they are to reasonably settle matters. If the parties won't agree to settle, there is only so much an attorney can do to compel their client and the other side to be reasonable. If a client indicates to their attorney that they wish to pursue further litigation, then the attorney is contractually bound to represent them until the case settles, until he withdraws as an attorney on the case or until his services are terminated by the client. The attorney can only "settle" a case with agreement from both sides or Order of the Court. The case won't be resolved until you and the "dad" are no longer disputing matters and you are both in compliance with the Court Order.

Look up the local chapter of the American Bar Association and give them a call. They may be able to help or at least point you in the right direction.

I say your best bet is to consult with another attorney that you feel has your best interest at heart. In addition, you should see if you can get your attorney or the other attorney thrown off the case if they are falsifying information.

If I were you, I would hire a different attorney, one who specialize in child custody cases. I would also prefer a woman as they seem more willing to go the extra mile. Good luck to you!

you wont get them unless you win in court and you probably wont since you obviously dont have custody. what ever it is you need to being paying or doing it for your child sake.

pay your child support

you cant your lawyer cant do any searching on his lawyer trying to find something his lawyer did kinda admits your guilt further since you want to say well your lawyer did this

grow up and take responsibility for wha ever you did or didnt do. theres an innocent child in this who is being royally screwed up by her parents childishness
