If something has been posted in the public domain at some point (eg a podcast), is it then legal to offer it for download?

If it was released into the public domain, then certainly, but merely posting something online does NOT constitute releasing it into the public domain. You would need the explicit permission of the copyright holder, either in the form of an individual release, or as a general relase under some sort of open license or explicit release into public domain, in order to legally copy the material and put it online so that others may copy it.

Being part of a pod cast does not make the material public domain even if it was pod cast by the owner of the material. It is no more legal than it is to record a song off of the radio and replay that for the public.

To host material on the web, you need permission from the copyright holder.

Public domain = free for download... you can't sell it though. You can put it on your site, but can't make a profit off of it directly or indirectly.
