Jet2 are basically claiming something was said on one of the calls I made to them and it wasn't would they let me have a copy of the tape? Also the person I spoke to was foreign and I seriously didn't understand some of what he said.
The problem is I spoke to 2 people and neither mentioned ridiculous increases in charges. Would they send tapes if it meant I possibly had a case against them. I accepted there was a charge but they are disputing whether I was told if the charge was increase ten fold over a few days.

Whilst I was on holiday the supervisor said they listened to the tape and it was mentioned but I know it wasn't and he also said that it was explained to me and I know that did not happen. I also called twice and it was not mentioned on either occasion. If they have nothing to hide they should send me copies of both calls.

Using the data protection act you would probably stand as good if not better chance as any other means to get a copy.
Do Jet2 specifically say all calls are recorded? My experience when calling various companies is that many say calls MAY be recorded for training purposes etc, not that they are. On that basis there is no guarantee that a recording exists and a convenient "get out" should someone be a little devious.

Most likely you would have to obtain a court order. It might be better to try disputing the charge with your credit card company. Tell them that you will not pay this charge. Stick to your guns. Never no matter if you say I must or not will I ever pay this charge. Hiring a lawyer and dragging this matter through small claims could take years, and by then they probably will have destroyed the tape. Companies usually only keep these things for a certain amount of time, maybe 90 days. Disputing this with the credit card company is much more likely to get their attention. Remember you have the right to dispute any charge on your credit card statement don't allow some customer service rep. tell you different. If they can't or won't help you escalate the call to the supervisor, then the manager, or higher if necessary.

Under the terms of The Data Protection Act you should be entitled to a copy of the tapes but i would imagine you'd need a lawyer to enforce that right. But, if you had a legitimate case I'd imagine that the company would just say that your telephone conversation was not recorded unless there was a clear cut mention of the facts that would strengthen their defence.

If ur in the UK, you should be able to get copies of the recordings of the calls under the Freedom of Infomation act. Basically this says that any information held about /involving you should be made available to you but ithink you may have to ask in writing. You need to be aware tho, that not all calls are necessarily recorded. Best thing you could do (again if ur in UK) is speak to your local citizens advice bureau, which you can find in phone book and they will give you legal references you may need. Their services are free by the way. Hope this helps.

not all that sure but I bet as the world is moving digital, it isn't actually saved to a tape but recorded digitally. This could well put it in the realms of the data protection act, to which you are fully entitled to see every thing they hold about you on computer, they cannot deny you this but they can request a fee for it.
If they are causing you grief it's always fun to give a little back.

You should be able to get them as they are a binding contract between you and the airline and therefore they are as much of your property as there, they have no right to kept hold of your data and not let you have anything to do with it under a freedom of speech kind of law. They will probably say that they havent got them, but they will you will probably be only be able to get hold of them via so kind of legal action, or even better refuse to pay your credit card as it wasnt something that you contracted into, and therefore have your money falsely

You will have to deal with a lot of pain and trouble to get the recordings. I doubt they will give them to you without you doing a lot of work, you might even have to cover some of their costs. Be persistent and keep asking, you may eventually get somewhere.
If this is part of a legal proceeding, then you can subpoena them as evidence. That is the only way you will get them for sure.

You can always ask. I suspect your question is whether they are required to provide it to you.
Just by request, no. If in court, and admissible as evidence, then potentially they would be required to produce the tape.

It's unlikely that they have one, if they do have one and you want a copy you would need to file a lawsuit and have your lawyer enter a motion of discovery.
