You would want to contact the jail in which your finance is being held to find out their policy and procedures. If it is a "local" inmate (not a courtesy hold from another jurisdiction or federal agency) then you would go through the magistrate to set up the marriage ceremony. You will not be allowed to invite a crowd, neither will you be allowed to have physical contact. It will be a civil ceremony by the magistrate, not a religious ceremony.
However, if the inmate is a federal inmate, you would have to contact the agency issuing the authority for the detainment of the inmate. With very few exceptions, they are held by authority of the US Marshals Service, or the bureau of Immigration and Customs Enforcement. Since BICE handles a large number if Immigration cases, their inmates are often not allowed to marry due to legal reasons. (Too many attempt to committ marriage fraud in order to attempt to stay in the USA.)

The question is why would you get married to someone in jail? honestly i am not trying to attack your question...and i dont know your situation with this person....but dont be dumb my friend just went through all of that!!! people never change! is that what you want to base your life and family on a person with a record now! who will never be what you need in life to provide...Think about the future and how much potential there is for another relationship with someonelse who can provide and step up to the plate!! i am 21yrs old so i aint no granny trying to preach to your...alll i can say is that this sounds so sad! i have seen my friend struggle and before you really do dont make that mistake!!! i know you love this guy or you wouldnt be trying to marry him!! why not wait atleast if you really want to!, until he does get out and for your own sake let him show you that he can improve in life and get a real job through a temp agency or something...just dont rush things!!! trust me , you WILL regret it!!!

Don't do it, it is nothing but empty promises from behind that wall and that is not even the beginning, when you find someone that can physically be with you, you will have to get your hubby from behind the wall to sign the divorce papers and he might not want to sign them. Call your county's sheriff's and or police dpt. they should be able to give you better information and how to go about proceeding.
