I filled out a pet info sheet and told the apt. management I would pay the deposit in the next few weeks when I had the money. It completely slipped my mind, and they never called to collect it either. A third roommate just moved in, and complained about my dog because she's allergic. The sales manager said that since I've already broken the rules and not paid the deposit, I either get rid of the dog or be evicted, they wont let my pay my pet deposit. I can't live without my dog, he's my rock. I can't terminate my lease in anyway either unless I find someone to take over it, which is tough because NOONE wants to live in these apts anymore even though they are brand new. What would happen if I got evicted? Besides that it goes on the credit report. And are they not supposed to give me a warning, then fine me, if I break a certain rule in the lease instead of just evicting me?

The dog is more important. He's done things for me noone would understand. And the apartment complex is a POS, so the dog is definately more important.
A roommate moved out, so a third roommate was assigned to us.

My lease isn't up for another year. My parents live over an hour away.
Being evicted is better than him staying with my parents, he's my psychological rock. My question is, what happens if I get evicted, besides the credit report blow?

When you sign your contract, you are under obligation to abide by the rules stated in it. However, let's analyze the situation. The deposit usually is to ensure that the owner will not lose money on the contract if something happens preventing you to pay future requirements on your pet, but usually you will get back such deposit at the end of your contract. Your roommate can complain all she wants about your dog, but if the contract allows for pets, she should have asked for a place where no one had one. Eviction is the last resource for an owner to deal with "trouble" tenants and that happens after both parties were not able to come up with a suitable solution to the problem. It seems that the management fail to provide you with reminders on your payment, so they have part of the blame. My best advice is to go through and read your contract carefully and see if late payment fees apply to your situation since the deposit was not submitted on-time after which it is both parties responsability to arrange appropriate outcomes.

Apartment complex is right. You have to get rid of the dog. What is more important? The dog, or the apartment? Your choice.

Wish the answer was better for you. I had the same problem with a cat. I fought it tooth and nail, and lost.

The boiler plate lease agreement spells it out. They have all the rights when it comes to pets.

Your best bet is to have your dog stay with your family or close friend until your lease is up and you find a new place.
maybe you can pay your friend a small fee for keeping the dog for you. Better than getting evicted.

Unfortunantly since you didn't take care of your responsability to pay the deposit at the appropriate time you no longer have any legal recourse. Your going to either have to find your dog or yourself a new home at this point.

Well, I think you have already made your decision. If your dog comes first then you have no other choice then to let them evict you and find a new place to live.
