My car has been in the shop for five weeks and they still havent finished reparing it!
There is collision damage in the rear- Not that major.
How can I get my car back if it is in pieces and they wont fix it 'cause they are waiting on some part.?Can I sue them?

Its not really fair to want to sue them because you have a car that has a lot of parts to order to repair it, most liekly you inadvertadly did this to yourself by buying a foreign car that has parts that must pass through customs which can take weeks all by themselves.

Waiting for parts is an acceptable reason for not getting it finished. If I need work done, I always sign a contract and have them get the parts in before taking the car to them. I understand your feelings but sometimes there are glitches. I am sure the repair shop does not like having your car taking up space either.

I'm betting you have an off-shore car. Nissan is famous for this. Dealers stock very basic repair parts (oil, filters, plugs) and that's it! The same thing happens around here all the time. Your insurance company should provide you with a car to drive. Believe me they scream at collision shops all the time to get work done so the rental bills don't get out of hand.

If you are going through your insurance to fix it, they might be wanting to do it cheaply, so they mechanics are probably looking for a used part to replace your damaged parts with.

I assume you signed a statement allowing them to repair your car, and this would keep them from being sued. The only way you could possibly sue them is if you knew the part was there, and they were charging you storage fees until they got to your car, and they were delaying it on purpose to collect more money.
They do want your car gone as soon as they can. With your car sitting there, its taking up space, and they don't get paid until it is fixed.

You should be given a replacement car for your daily usage. Your garage will claim ferom your insurance company include the rental fee when job is completed.

i'd get on to the cops man! you should have kept it till they had the part! 5 weeks seems an awfull long time to be waitin for a part!
