Its there in all todays news reports: that he has not got a copy of the judgment yet; that his behaviour during bail as an undertrial was exemplary; that his Appeal will take years to be heard, and that his Probation of Offenders Act application ought to be considered.

Apart from that, if Navjot Siddhu who beat an elderly man to death in a fit of road rage and was duly convicted, if he could get bail pending his Appeal, then why should'nt Sanjay?

Sanjay may not win his Appeal however, because the CBI and other Appellants are bound to highlight that he was acquitted under TADA but convicted only under Arms Act, which is quite discriminatory compared to some of the other convicts.

The charge against Sanjay Dutt is that he was having an advanced fire arm in his house, He neither carried it nor appeared on the scene of any riot or arson,He was clamped under the draconian TADA.
On the other hand,Madhukar Sarpotdar, a VIP of Siva Sena was moving about with a gun and ammunition during Bombay riots that led to Bombay blast.He was arrested but not brought under TADA.
In a democratic set up all citizens are equal before law.Can we say that now?

He should not be given bail. He deserves this and if he thinks he has changed he should take this punishment for good and do some Gandhigiri in jail and help other jailmates to improve......
