In your last question I had told you the fasted way to get divorce in Indian by mutual consent were both the parties move joint petition in the family court & can get decree of divorce only after six months from the date of filling this petition. As far as what law will be applicable to your marriage then first tell what is the religion of both of you & according which religious form of marriage you got married, if it was a court marriage that took place between both of you then you must have got a marriage certificate regarding this marriage, that certificate itself mentions under which Act you got married. In Kuwait as you say you got married then if it was a court marriage as you both belonged to different religion or even same religion before a Marriage officer/registrar who happens to be an Indian Embassy officer there then it must be under the Special Marriage Act, 1954 if both of you were Indian or under the Foreign marriage Act, 1969 if any of you were not Indian. If you both happened to be Christian by religion then you must be married under the Christian Marriage Act, 1872 either before a marriage officer/registrar under the said Act or in church by the priest. In such a case you apply for Divorce under the Indian Divorce Act, 1869. If you both are Hindus the you must have got married by a Hindu priest & your marriage then was preformed under the Hindu Marriage Act, 1955. If you happen to be Muslim by Religion then the Qasi must have got you married before two witnesses, then the Sharit law is applicable to you both but you can get Khulla & even divorce under the Dissolution of Muslim Marriage Act. These are the applicable laws in your case depending your religion & form marriage you have gone through.

Which law is applcable to you it depends on your religion if you are an Indian Muslim, Muslim Divorce act is applicable and if you are a Hindu by religion Hindu Law is applicable. You have not given such particulars to give a good advice to you, anyhow, it is better you consult any Advocate in India by furnishing the following particulars to him;-
1. Your religion
2. date of marriage
3. details of your spouse
4. reasons and grounds for your divorce
5. your place of residence in India
6. whether you have resided with your spouse in India, If yes give details such when, where and for how many years.

Hi, I am Vimal. I am practicing law in New Delhi. You can get divorce fastest by Mutual consent. That is if both parties are willing to divorce each other. Maximum it takes is six months. U also need not come to India. U can just send a Power of Attorney in favour of one of your relative or friend who will appear on your behalf and make statement in court.

i'm not a lawyer but still, i think you can file the papers from there through some attorney you know over here... (do a search online)
anyway, you will have to present yourself in india when the case comes for the hearing. you cannot postpone the case for a long time, so it would just be better if you came right now, and then filed the case.
