A friend of mine has separated from her husband who lives nearby. For the past year he takes their 3 children on a sunday for 5-6 hours. Wanting to move on she is going to mediation. In mediation however, he is asking to have the children 3 1/2 days out of the week. Is this reasonable? My friend is concerned that the children will not end up having a stable relation. She does not mind the husband having the children for 3 days - but only days rather than sleeping there as well, as her husband (a taxi driver) is currently living in a flat above a shop where other guys also stay on and off. In addition he is appealing a decision by the CSA of paying 30 per week child maintenance, claiming that out of the £150 per week he makes he only has £11 per week left after expenses. My friend knows he is lying but cannot prove his income. Do you think he will get the children for 3 1/2 days including nights?

He only wants them because if you share custody there is usaully no support order. She should definitely try to keep the kids in one home on a regular basis. That may mean that she has to allow him to come over to her home more often than she would like, so that the kids see their father but aren't displaced.

unless he gets a court order and to be honest by the sounds of where he is living with other guys on and off its unlikely, this can only go ahead with your friends consent and yes if it goes ahead he can inform the csa and those days/nights will be ducted from the money.. your friend can ask the csa to look in to his money again but this can only be done twice in the first two years.. so maybe for now your friend may want to agree to days but not overnights until he has his own place to take the children..your friends sounds like she is thinking of her children and her ex,his a muppet to have let her go..hope this is some help..

Only if the courts decide for them to stay. I would be a little weary of other men coming and going at his flat. It doesn't matter if he has nothing left after paying support..these are his children.

2 things if kids stay at his 3.5 days of the weeek they gonna get disrupted from school its best to keep them stable and leave dad se them on weekends or holidays. its called shared care look into it with the csa i think if he says he has the kids for weekends and holidays the payments will go down

If the courts don't think it's safe for the children to stay nights with him, they won't allow it, or shouldn't allow it.

there are actual court cases indicating that having shared care of children will actually cause physcological harm to the children.......secondly...sounds like he is just trying to find a way not to pay support........as for his income.....request tax forms for the previous year......legally she can do that....and if he is not filing taxes....well what a nice surprise the judge will have for him....
