It's really sad that you have gotten yourself into this situation. If she is able to get alimony and that causes you some financial hardship, so what, that's what you get when you are messing with a married man! Get a job! Buy your own car! Learn how to provide for your child!

Some of the above answers are out to make you look bad. My divorce took over two years to settle and I did not consider myself married during that time. don't let these people tell you your at wrong here. YOUR NOT! You have his child. Leagally we were but I was not going to waste another two years waiting to see anyone. Chances are he will not have to pay alimony or it would have been already imposed on him during a seperation. (if it was legal). I would think he would want her to either help out with some of that debt. My current husband paid child support and alimony during their seperation then the alimony was dropped after the divorce. (she made more than he did in the first place but she kept the house and they made him pay 1/2 the payment and alimony) The both went through bankruptcy and cleared themselves of the debt.
He will have to pay you child support if you deceided to leave him so the judge might take that in to consideration when figureing all this out. The only person that can tell you for a sure is a Lawyer that knows divorce laws in your state.

No your income cannot be considered in the determination of child support payments nor will it be considered if decide to marry this guy. You should be happy that she is pushing for the divorce and more concerned as to why your boyfriend has not finalized the divorce in the first place. Divorced, separated or not, the man is responsible to help provide for his children period. Whether the divorce is final or not will not have any bearing on the amount of support he will have to pay. They have been separated to long for alimony to even be considered so my question is what is his deal and why is a hottie like you fooling around with a dude who doesn't want to support his kids?

If the car was with them when they were married she probably would be able to get it but if they have no kids then she cant get child support or alimony. Your safe there. I went threw the court system so if she wants to take him to court maybe you should let her because if he had 40,000 in debt when they broke up she will be paying half of that.

It depends what state you are in and how long they were married. (He married a woman nearly 30 years older than he is? Doesn't that seem strange to you?) Anyway, he just might have to pay her alimony for up to 5 years, AND he will probaby have to give her one of the cars. As for the debt, she may be partially liable for that, too, though.

Typically women get alimony if they gave up a career to take care of a family.

Who knows for sure besides the judge who will preside over the case? Chances are, no.

But just remember, there are only TWO absolutes in life: You WILL die one day and you WILL have to pay taxes. Everything else is hit or miss.

Why have you been with a married man for a year and a half? Are you the reason they split up?

I am so proud of you two for setting a good example for the kids. Be sure to tell them whole story of how you met and ended up together.

See an attorney.
