doubtful....if there are kids involved.....and depending on how bad she wants to stick it to him....the guy almost never gets anything of value in the divorce because the courts are so biased towards the women.....he might as well give it up and accpet the fact that he probably will get screwed, unless he has something really good to hold over her in court....

Dear TJ. most women or wives would say "Why are you asking this and not an attorney for your dad. I'm glad you are concerned. You and your dad can keep the house if you stay with him and live in it. He will have to buy her out when you are an adult and leave. But most courts and judges will allow him to stay in the house without buying her out until you are grown....You can write me if you wish. I have been through this before. I know what can be done in divorce situations......

He could ask for the house in the divorce. They are both entitled to it. He could talk to her and see what she says. She may not want the house.. it does happen !! It would be best for the attorneys to deal with ! Good Luck !!!!

You need to ask them this, there is no way of knowing how they will split the assets, or who the courts will side with when it comes to disagreements on who gets what. its a heck of a lot more involved than you think. So you don't need to worry yourself with this. So long as you have a home and loving parents, that is all that matters.

He would have to talk to an attorney about that. The house should be considered community property- BUT- frequently the parent who gains custody of the children gets to stay in the house.

TJ - this is not a question a child should be asking. Your father is an adult and if he wants to get a divorce, he needs to discuss things with an attorney, not his children.
