My best friend's husband is in the Military and has stopped sending spousal and child support to her when their marriage started to fall apart. The Military isn't doing anything about this, and I am curious as to why?

He won't get away with it for long. The military REQUIRES that child support - at least - be paid. I know because my son's father was a Marine ... and I had to take him to court, but was awarded FULL custody and MAXIMUM child support. Tell your friend that she better not let him get away with it. The military has different laws then the civilian world and they will put servicemen/women in prison for not paying child support.

I did not even need a lawyer ... I hired a paralegal and represented myself. I went to the Family Law court here in my county. The military also offers FREE legal services to spouses and children of military members. She can always start there if she's not sure what to do and they'll assign her a lawyer to help her - free of charge! Make sure she follows up on this ... she has a legal right to this support. I'm sure she'll need your support as well ... so be there for her!

If you haven't legally gotten a divorce you should contact an attorney and file for one. If you can't afford an attorney check and see what legal assistance is offered in your area. Not knowing all circumstances, I would imagine that the military allotment for child support may be as a result of that NJP. If you're not divorced and take him to court the amount you're collecting would be subject to whatever the court awards. Depending on circumstances, and a good lawyer, you could even add alimony to what you're collecting as well as an increased child support payment. It sounds as if he screwed all over you and is only paying because the USMC requires it. Get a lawyer!

Well whether he's in the military or not, why hasn't she filed for divorce and started a court order for him to pay?
Military has nothing to do with it.

I guarantee there is something they aren't telling you. They will be compelled by the military to take care of their obligations.
That is why places love to rent to military people, they know they will get their money one way or another. I've seen this happen again and again. Somebody thinks they PCS and they won't take care of their bills.. wrong answer!

That is HORRIBLE!! SHe needs 2 get a lawyer and then the military will comply!
