I rent an appartment owed by a man not a leasing company. My lease ends on Sept. 23 of this year.

The owner told me today that he will be selling in October and that I will not be able to renew my lease and that I'll have to move.

What are my rights as a renter as far as them giving me time to find a new place and move? I'm sure they can't just say "ok you gotta go NOW"

Legally how long do I have to find a place and move.

any other info or advice is appriciated. I will be speaking with the owner tonight and I would like to be prepared with some info. He is a reasonble and nice man.

I work in a real estate office and we deal mostly with sales of rental property. Your landlord only has to let you stay until the end of the lease date and has no legal obligation to renew your lease. They usually have to give you 30 days notice of intent to not renew. Most owners have a easier time selling their property if there is a chance that the new owner has the option to occupy the property. You may be able to get the owner to let you go on a month to month but usually they will raise the rent 50-100 dollars. I'd just look for a new place, you never know how the new owner will be.

Your legal rights are determined by your state's laws.

Generally, when a building that has rentals in it is sold the new owner must abide by the the signed leases. So if he agreed to another year lease the new owner would be legally required to let you stay. UNLESS the lease had an written out in it. Many leases include a clause that allows the owner to give 30-60 or 90 day notice when the building is sold. So a lot depends on the lease document.

He may not want to or you may not want to sign yourself up for another year knowing about the sale. What about a month to month lease. Which means you would have about 30 days notice to leave.

A lot depends on what the new owner wants to do. Is the new owner going to rent the place out or move in. Would the new owner raise your rent, Is the new owner going to go condo on the apartment. The new owner, if the deal has already been signed, may not allow this nice man to offer you any rental beyond Oct.

As your lease expires on Sept 23, if neither party says anything, you move out on Sept 23.

If both parties agree you can create a new lease. As the landlord has made it pretty clear he doesn't intent to enter into a new lease, I would start look for a place to live.

Being many places begin and end leases at the end of the month, if you ask nicely and don't claim some legal rights you don't actutally have, he might let you stay until Oct 1. Or maybe he will let you move out early -- Sept 1.

But your legal rights are to the apt until Sept 23. He can not throw you out on Sept 22.

Once the lease expires and it doesn't have a clause that allows it to automatically renew, you just simply have to go. In reality, you could squat there and stay there a couple of more months until he gets a court order and brings the county sheriff because landlords cannot legally throw a tenant out themselves, but he might try to come after you and bill you for the court fees and you won't be able to use him as a reference for your new landlord.

well since the lease is between you and a person than is no longer going to own the property, the new owner will not be bound by any of the old owners contracts/leases.

the landlord is usually bound by the same terms as the lessee; namely that you will have the right to residence for the term of the lease and that you or the landlord must give 30 days notice. it sounds like he's given you more than 30 days notice. neither you nor the landlord is legally required to retain one anothers services beyond the term of the lease.

i would start packing if i were you. most states favor landlords over renters. property owners pay land taxes, consequently, they are favored by the local authorities when there are discrepancies between landlords and lessees.

since laws vary from state to state and even county to county you need to read your lease. you should have been given a copy when you signed it. if you've lost it ask your landlord for another copy. read it carefully.

You have to check with the state laws, some states you are only allowed 30 days notice, if you signed a lease that info should be there, it's the little fine print.

If the lease is ending, you don't really have any rights after that. He's given you almost 2 months notice, that's better than you would get a lot of places.

It sounds like the owner is doing everything he can to make sure you have plenty of notice that you will have to vacate.

At this point you need to locate another apartment or house as soon as possible. Fortunately you have plenty of time to find a place and coordinate the relocation.

Maybe you could even plan a moving party to entice your friends to help you lug your stuff to the new place!

Well, you already knew about your lease fixing to end......also he's told you atleast 2 months in advance....i'd start looking elsewhere!

Since the courts are very liberal
you have an extremely good chance to stay as long as you pay the rent.make sure you send your rent check registered
mail signature requested.If you want to take this all the way
I'm sure the courts will give you three or four months to find another place.
