My husband's ex-wife has custody of the 17 year old, with support payments, but the boy lives with us. Who does the paperwork, including ending paying the support?

Normally the person requesting the change does the paperwork. Unless you file it, the courts will assume you are still that the situation in the previous ruling still applies.

Both parents are supposed to come together inform the courts, but since it's your husband the one paying the child support, better get a lawyer, you want to make sure the courts are aware of the change that way if he stops the child support, and it's all documented on why.

Remember that the laws are a bit different in each state when it comes to this so better be safe than sorry.

Unless you want to keep paying your husband's ex child support for a child living with you then you need to get the paperwork together. After all, what is there to motivate her? She is in a win-win situation. BTW, if she has legal custody she can come and take the child at any time. Your husband should get moving on the legalities ASAP.

I would contact a lawyer. I believe when the child reaches a certain age they are able to choose. it will depend onwhat reason he is living with you. I believe that your husband has to get a lawyer and explain the situation so they can notify the system. I would document or get documentation of all the support payments that have been or are being made while he resides with you. You should be able to get that money back. Depending on the income of the ex wife your husband may even qualify to get support payments from his ex.

You need to hire a lawyer to stop the child support payments to the ex-wife. If you are taking care of the son now you still have to go through the courts to sign papers for legality purposes. I would do this immediately. The ex could after taking the money return it back to the ex for the childs use. If she isn't then she is taking advantage of the exhusband and that isn;t right. Whoever has legal custody of the child needs to contact the Child Support dept. However, you should tell your husband to contact them also. This is in case the ex-wife forgets or would like to continue receiving child support checks. At least the dept will have a record of what's going on.

who's paying childsupport? Have a friend with the same situation but the ex sued the other ex because child support wasn't paid all summer even though the child did not live with them...they won. Do your homework and get legal counsel.

The person who wishes to stop paying child support should take the responsibility to fill out the paper work- otherwise it might never get done.

It has to be changed in the court system in order to stop support payments.

If the child lives with you, how does the mother have custody? I think you should see a lawyer
