While stopping (my speed was not registered) yesterday, I bumped into the back of the car in front of me. The women got out, was very rude, demanded my insurance, but did not offer hers, and neglected to call the police. Personally, I don't think there was any need as there was no damage to either car. She called my insurance company herself ( she did not contact her insurance company) and asked them what she should do with her bill (she is complaining of neck soreness). The company said she would have to file a claim before anyone got any money. My insurance company also asked her about the damages to the cars, and she said there was none.
She has filed for injury, but I was told today that she filed no claim on her car, which makes sense because there is zero damage so she couldn't get any money that way. She was not that old, and not that frail so I highly doubt that my maybe 5 mph bump would jerk her head enough to cause any injury. What do you make of this situation?

I should add that a close family member of mine was just rear ended. She was hit the first time and the car was going at least 50 mph, then she was hit again by a second car. Her car has extensive damage the the fender and the muffler. She has no injury.

I wouldn't worry about it, if you have a good insurance agency, they will handle her.

She may have an injury, even getting hit a low speed, esp. when stopped can cause it. I have a steel rod in my back, so it is more difficult to cope with stresses such a mild rear-ending. Although I am "pre" damaged, a person hitting me would be responsible for making me right again. No one can tell I have this condition by looking at me (unless I am wearing something that shows my scars from surgery).

I am not saying it is right, I am just saying she may actually have an injury. If she is just playing it up to try to get some money, well, as I said earlier, your insurance co. will take care of her.

This is why you have insurance. Her insurance and your insurance will battle this one out. If you live in Illinois you, your insurance co attorney, her and her insurance co attorney, may come be an arbitration board to review the claim. It is common for anyone, and I mean anyone no matter how injured or damaged, to file a claim. It has no reflection on you, your driving, or the truth. It is just the way things are. Many people what that big pot of gold and will sue any insurance company for it.

next time if you are in an accident and the other person will not produce insurance, call the police immediately. They are required to show proof of insurance to them. If you tell ehr you are calling the police and she leaves the scene, she can be charged with hit and run even if she was the one being hit. She left the scene of an accident.

always be cautious when dealing with people who are shifty, call the police immediately to protect your interests.

Just make sure you reported the incident to your insurance company. Some states, like PA, have laws that say you have to call the police if anyone is claiming injury.
If the woman violated the law, it affects her credibility.
