Jerry is smarter than Tom. He always think of ideas and help from a friend. That's what makes him smart. But sometimes, Tom wins. So, it depends. Mostly Jerry wins. So in my opinion, Jerry is smarter than Tom.

Because that is how it is drawn. But also because if Tom were to get Jerry the show would no longer have its plot anymore. And because Jerry is obviously an ancestor of Brain from Pinky and the Brain and understands how to create great planning, but still no way of taking over the house and being kept to just the one mouse hole in the wall because of Tom.

Easy, Tom was contracted to chase out Jerry, if Tom ever remove out Jerry then Tom will be jobless.
One story once told about Tom being jobless and then cooperate with Jerry to get his job back.
So as you can see, it's all about job security.

Tom has only gotten the best of Jerry only a few times, and when it comes to Wile E. Coyote, he NEVER EVER caught the Roadrunner. I knew that when I was 5 years old because he never caught him then and he will never catch him now. I'm suprise that he didn't starve to death or something. Come on think about it, what did Wile E. eat when he never catches the roadrunner?
