He has repeatedly been told about loud music and still I have received complaints and this time it makes four complaints and he has been warned before.

Depending on where you are in Georgia (I am in Cobb County), you might be able to file online.

It is called a dispossessory (nice name for eviction). You file it with the Magistrate's court. Cost should be about $72 for a single person (again depends on the county).

The Sheriff's department will "tack notice" (literally) to his door. He will then have seven days to "answer" the summons. If he fails to answer you will be issued an immediate writ of possession (blue slip).

If he answers you each get to tell your tale to the judge. Be professional and have solid documentation of your gripe. Be prepared to show the lease and point out where loud noises are not tolerated in the contract. You do have that in the lease, correct?

Magistrate's court is a circus. You paid to get in there so enjoy the show! Best of luck.

Only the courts can order an eviction. The court clerk's office can probably advise you on the mechanics of the process. An attorney can handle it for a fee which you can go after the tenant for as part of the eviction process.
