2-3 million, easy. a doctor that stitches a woman's bowels during a c-section suture has no business dealing with newborns, no less adults. the poor woman didn't have bad luck, she had a bad doctor. the problem is whether or not you want to bring suit against the doctor. sure the doc has malpractice insurance, but do you want to go over every detail over and over so the insurance company can try to "catch" you in an inconsistency? insurance companies don't want to pay out, and the effect on the doctor can be a loss of the ability to be insured, which can result in the doctor not being able to practice. i know the mom doesn't care, but the insurance company does.
mom definitely has a case based on what i have read, but it isn't easy to get the money she is owed. and, sadly, no amount of money will bring back the first 4 months of her baby's life and the memories she lost.
it is a tragic situation and i hope her life can improve so she can be the mother she wants to be for her baby. this breaks my heart.

You broke the law, and it is everything. Nothing will change until you make up your mind to stop smoking marijuana. It slows reaction time, and if you are handling a baby, it wakes up and you are high...don't go there thinking about it. The law is the law, and the Clinton era is over, I hope. Smoking marijuana is illegal for a reason, and leave it at this. Do not break the law, ever, for anyone. Your life could get careless in other ways later. Everythings changed, until you come forward and tell you're mom you knew it was against the law, and now you've made the right choice. She could really hurt you with the authorities, and take the baby. This isn't an "I want my way, mom, please?" situation, this is legal. Make the right choice before your mom fears and resents you very much, thank you.

No punishment to the doctor...they're not perfect, they're human and they're going to make mistakes. That's what medical malpractice insurance is for.
As for monetary compensation, I honestly don't know how you determine how much having children is worth but as far as everything else I would say all the medical bills should be covered as well as any future medical expenses that are a result of this. And if her life is still in danger the cost of raising the child should be considered...if she dies as a result of this doctors negligence she would be unable to provide for her family and that should be considered. If I had to guess, I'd say a few million...like 5 or 6...if I couldn't have anymore children because of something like that it would take a lot of money to make up for it.

Unfortunately, President Bush signed a law allowing for a cap in regards to malpractice cases. The mother is probably not going to get enough financial compensation to take care of her health problems the rest fo her life. I, personally, would award her and her child, free health care for life with the doctors of her choice as well as compensate her financially (on a yearly basis) for whatever job she had before the horrible story above. If she were a stay at home mom, there are plenty of ways to determine what that job is worth in terms of yearly salary.

That's horrible!! Money can't buy back her health nor the time she missed out on with her baby. I think the Dr. should be punished, but how do you punish a crime like that? If he cut her on the street, it would be attempted murder. But be cause it happened in a hospital, it's a medical "oops". He can only hope he's got enough malpractice insurance to cover it. He's an M.D. so he probably won't do jail time, like we "common folk" do if we were to screw up.

That sounds like clear medical malpractice on the doctor's part and damages well into the seven figures. I hope she got a good malpractice attorney. If not, and she lives in the NYC area, I can recommend some.

Getting pregnant is a risk. If a woman thinks they're special enough to not succumb to any of these risks, well let me enlighten her to the fact that she is not. When one goes in to surgery, they need to understand that things may happen. The human body is not an exact science, and mistakes are bound to happen at some point, because doctors are humans. They are not Jesus. They are not perfect. Nor are they are magicians. Surgery requires very sharp surgical instruments in very tight quarters. It's unfortunate she became so ill, but she decided to get pregnant. Had she not, there would be no predicament for her to be in.
The malpractice in this country is OUT OF HAND. If we keep suing doctors for acts that they did not mean to commit, then there would be no doctors left to treat the ill, due to the fact that there would be no way for a physician to be able to afford it. Then the world would be in a very bad state of affairs.

WOW i don't think any doctor would ever do that on purpose but she definitely deserves to be compensated. I wouldn't even know how to put A DOLLAR AMOUNT on that sort of tragedy.

that is a very sad story. I'm sure there would have to be some kind of mal practice that would be fair.
